Man Nearly Loses Eye After Impact by Large Concrete Slab Being Hauled by Tractor-Trailer

On December 9, 2020, a Harris County resident (hereinafter “Man”) filed a complaint in the Harris County District Court against Rincon Trucking, LLC (hereinafter “Defendant Rincon”) and Juan Antonio Vasquez (hereinafter “Defendant Vasquez”). The Man asserts causes of action for negligence and gross negligence against Defendant Vasquez and he asserts causes of action for negligence, negligent entrustment, negligent hiring, supervision, training and retention, respondent superior and gross negligence against Defendant Rincon as a result of an incident (hereinafter “incident”) that nearly caused him to lose an eye.

The incident occurred on August 13, 2020, when, at approximately at 8:13 a.m., the Man was safely traveling southbound on FM-362 in Waller County, Texas. At the same time, Defendant Vasquez was headed north on FM-362, driving a 2007 Freightliner tractor and towing a 1999 Utility Trailer MFG trailer, both believed to be owned by Defendant Rincon, that was hauling a large concrete slab. Both the Man and Defendant Vasquez were approaching a bridge with no shoulders. Defendant Vasquez nevertheless proceeded to enter the bridge despite the concrete slab on his trailer occupying the Man’s half of the road. As a result, the concrete slab’s left side collided with the Man’s vehicle’s left side, damaging his vehicle and causing him serious personal injuries-in particular to his eye and side of his face due to the impact from the concrete slab.

At all relevant times, it is believed, Defendant Vasquez was acting in the course and scope of his employment with Defendant Rincon and acting in furtherance of a mission for Defendant Rincon’s benefit and subject to its control. Defendant Vasquez was found at fault by Texas Department of Public Safety investigating officer and he was cited for failing to give one half of roadway meeting oncoming vehicle.

The Man seeks monetary relief for damages resulting from, among others, medical expenses both past and future, physical pain and suffering both past a future, and mental anguish, among others.
