Man Sues After Mouth Injury Allegedly Caused by Liquid Nitrogen Infused Cereal

On April 29, 2018, Russell Lane Mattison Jr. tried a liquid nitrogen-infused cereal called Dragon Breath at a kiosk inside a mall. After several bites, he experienced sudden and intense pain and his mouth filled with blood. Over the next several weeks, Mr. Mattison had difficulty eating and drinking due to sores on the inside of his cheek. Mr. Mattison filed suit.

Mr. Mattison has alleged that the cereal is soaked in liquid nitrogen, which allows vapors to emit from the nose and mouth when eaten. He claims he and his wife got a refund from the kiosk since it was thought that his cereal was soaked too long before it was served. Health care providers have verified the injury was due to a burn from the food. Specifically, according to records, Mr. Mattison suffered “ulceration of right buccal surface with bloody ooze from right wound edge at base of ulcer from ‘Dragon’s breath’ liquid nitrogen soaked cereal.” Mr. Mattison’s suit goes on to note there were no written warnings at the kiosk that informed customers that the food was potentially dangerous.
