Mother Sues Daycare after Daughter given Fish Sticks despite Severe Allergy

A daycare is accused of allowing a preschooler to eat fish sticks despite having knowledge that she has a severe food allergy. The 3-year-old’s mother says her daughter was given fish sticks twice in a span of four months. The family has filed a suit against the daycare.

According to the lawsuit, the second time the child was given fish sticks, she went into anaphylaxis, which is a severe allergic reaction. The child’s mother stated that her daughter was found in a bathroom barely breathing and with a swollen tongue, lips, and face. The lawsuit goes on to claim that the daycare did not contact emergency medical services or follow the girl’s emergency allergy plan, but instead, called the mother, who then called 911. First responders administered two EpiPens and gave the child an oral medication to combat her anaphylaxis during transport to the hospital. Per the lawsuit, the mother was told by first responders that if she had waited five more minutes to call 911 or tried taking her daughter to the hospital herself, the young girl would have likely died of anaphylactic shock.
