Lawsuit Filed after Man Shot at Houston Apartment Complex

On May 25, 2023, a petition was filed to initiate a lawsuit in the Harris County District Court against multiple entities, including an owner/operator, associated with The Park at San Marino apartment complex (hereinafter “Defendants”) as a result of gunshot wound injuries sustained by a resident (the “Man”) while inside his apartment home. The lawsuit asserts causes of action for premises liability, negligence, and gross negligence against the Defendants as a result of the shooting incident (“incident”) that resulted in permanent injuries, scarring, and disfigurement, among other related conditions.

On May 26, 2023, according to the lawsuit, the Man, a resident at the time, was shot and severely injured when he was awoken by armed assailants burglarizing his apartment. The Man was shot that evening by the armed assailants who had obtained uncontrolled access to the apartment complex through a broken and/or inoperable vehicle entry/exit gate.

The Man brought the lawsuit alleging Defendants’ negligence and wrongful acts were the proximate cause of his sever and permanent injuries. The lawsuit asserts that this particular incident was not the first instance wherein the apartment complex experienced a shooting incident or other violent criminal activity. In fact, the lawsuit asserts, this incident was at least the third shooting that led to injury and even death in recent years at the apartment complex. Despite these frequent events, coverage of the same by media outlets, as well as constant complaints by residents, the Defendants’ have altogether failed to implement additional safety and security measures. As a result, the apartment complex and its premises have remained open for anyone to gain uncontrolled access to the premises.

The Man seeks compensation in excess of $1,000,000 for his damages including past and future pain and suffering, disfigurement, impairment, medical bills, and mental anguish, among others.
