Intoxicated 18-Wheeler Driver Causes Houston Woman’s Death

On April 20, 2022, two Harris County residents filed a lawsuit in the Harris County District Court against  E.M.A. Transport Services and Pablo Isai Frias (hereinafter “Frias”) as a result of the death of Miriam Buentello, deceased (hereinafter “decedent”). The lawsuit was filed by the decedent’s husband and the decedent’s mother asserting causes of action for negligence and gross negligence against Defendant Frias and asserting causes of action for negligence, negligent entrustment, negligent hiring, supervision, training and retention, respondeat superior and gross negligence against Defendant E.M.A. Transport Services as a result of an incident (hereinafter “incident”) that caused the decedent’s fatal injuries.

The incident occurred on April 18, 2022, when, at approximately 11:35 a.m., the decedent was safely traveling on I-10 near McCarty St. in Harris County, Texas. At the same time, Defendant Frias was traveling on the same stretch of highway, while driving for his employer, Defendant E.M.A. Transport Services, when he violently rear-ended the decedent’s vehicle. The crash resulted in the decedent’s fatal injures

At all relevant times, it is believed, Defendant Frias was acting in the course and scope of his employment with Defendant E.M.A. Transport Services and acting in furtherance of a mission for Defendant E.M.A. Transport Services’ benefit and subject to its control. Local authorities and investigators determined Defendant Frias was intoxicated at the time of the crash and he was subsequently arrested and charged with intoxication manslaughter.

The family of the decedent filed a wrongful death claim and seek monetary relief for damages they have suffered including loss of companionship and society, pecuniary loss, and mental anguish. The family also filed a survival action seeking pain and suffering, mental anguish, and other damages the decedent sustained while alive.
