Woman Sues the Wortham Center After Fall on Uneven Surface Caused Head Injury

On April 2, 2021, a Harris County resident filed a complaint in the Harris County District Court against Wortham Center Operating Company, Wortham Ticket Center, Wortham Theater Foundation, Houston First Corporation (hereinafter “Wortham Defendants”). The woman asserts causes of action for premises liability and negligence against the Wortham Defendants as a result of a fall incident that occurred at The Wortham Center. The Wortham Defendants together owned and operated The Wortham Center at the time of the incident. The woman’s fall, caused by an uneven surface, further caused her to hit her head against metal resulting in serious injuries.

On June 7, 2019, according to the lawsuit, the woman visited The Wortham Center in Houston, Texas. The petition states that, while entering the building, the woman tripped and fell on an uneven surface near the escalator and fell forward. The fall caused the woman to strike her head against the metal on the escalator. As a result of the incident, the woman asserts she suffered serious and painful injuries.

In the lawsuit, the woman alleges the Wortham Defendants’ negligence at the time of the incident was a proximate cause of the incident. More specifically, the woman asserts the Wortham Defendants failed to exercise reasonable care to reduce or eliminate the dangerous condition on the premises, failed to provide a reasonably safe environment for invitees, failed to give adequate warnings to invitees, failed to inspect the premises for hazardous conditions that might cause injury, among other negligent acts and omissions. The woman further asserts that the Wortham Defendants’ negligence resulted in her injuries and damages claimed in the lawsuit.

At the time of the incident, the Wortham Defendants had a duty to keep and maintain the premises in a safe condition. Due to the condition of the uneven surface of the floor, the woman asserts, The Wortham Center premises was not safe for invitees.

The woman seeks monetary relief for damages resulting from physical impairment, mental anguish, disfigurement, lost wages and loss of earning capacity, among others.
