Man Sues Kroger After Slip and Fall Due to Leaking Refrigerator  

On March 18, 2021, a Harris County resident filed a complaint in the Harris County District Court against Kroger Texas L.P. (hereinafter “Kroger”). The man asserts causes of action for premises liability and negligence against Kroger as a result of a slip and fall incident caused by water leaky from a refrigeration unit.

On May 5, 2020, according to the lawsuit, the man visited the Kroger grocery store located at 12555 Briar Forest Drive, Houston, Texas. The petition states that, while inside the Kroger, the man slipped and fell in water that had accumulated on the floor as a result of a leaky refrigeration unit. The leak continued into the aisles of the grocery store and the man further asserts Kroger failed to contain the water leaking from the refrigeration unit.

Based on the man’s allegations that Kroger was negligent in the way it attempted to contain the dangerous condition presented by the water on the floor of the grocery store, it appears Kroger employees may have had knowledge of the water leak. The man claims the fall caused him to sustain serious bodily injuries and damages.

In the lawsuit, the man alleges Kroger negligent actions and omissions on the premises at the time of the incident were a proximate cause of the incident, including his injuries and damages resulting from the incident. Specifically, the man claims Kroger knew, or should have known, of the water on the floor and that Kroger failed to maintain the area in a safe manner. Further, the man alleges, Kroger failed to adequately warn or make safe the area where the water was present.

At all times necessary, Kroger had a duty to keep and maintain the premises in a safe condition. Due to the condition of the water on the floor, the condition of the grocery store premises was not safe.

The man seeks monetary relief for damages resulting from, among others, medical expenses both past and future, physical pain and suffering both past a future, and mental anguish, among others.
