Teenager Over-served by Bar Causes Fatal Collision

Two minutes after leaving a bar that served him over a dozen drinks, an intoxicated 19-year-old driving a pickup truck veered into oncoming traffic colliding with an SUV. The driver of the SUV was killed. The driver’s mother and 1-year-old child were injured.

After his arrest, the 19-year-old appeared to be too intoxicated to keep his eyes open for a mugshot. Five employees of the bar were arrested and charged for offenses including selling alcohol to an intoxicated person and to a minor.

Establishments that serve alcohol owe a duty to the public to not serve already intoxicated patrons, because those patrons present a risk of death or injury to others. Texas’ dram shop act holds establishments liable for serving alcohol to individuals that are obviously intoxicated to the extent that they present a clear danger to themselves and others.
