Confidential Settlement Reached in Dram Shop Case Against Chilos Seafood Restaurant Incorporated

Firm Partner Benny Agosto, has reached a confidential settlement against Chilos Seafood Restaurant Incorporated regarding an incident that occurred on January 12, 2015. The settlement brings a favorable end to the lawsuit seeking compensation for the death of Ms. Allison Gallegos and Mrs. Eliselda Martinez in a car crash.

While at Chilos, Tucker Sims was served alcoholic beverages after it was apparent to Chilos employees that Sims was obviously intoxicated to the extent that he presented a clear danger to himself and others.

After becoming intoxicated at Chilos, Mr. Sims left the bar driving his vehicle. While driving in an intoxicated state, Mr. Sims eventually entered the exit ramp of the IH 610 North Loop and drove in the eastbound lanes of the North Loop of IH 610 traveling in the opposite direction from the designated flow of traffic.

As Sims was traveling in the opposite designated direction on the North Loop of IH 610 toward oncoming traffic, his vehicle crashed into our client’s vehicle at a high rate of speed. The front seat passenger of this vehicle, Mrs. Eliselda Martinez, was declared dead at the scene. The backseat passenger, Ms. Allison Gallegos, died en route to Ben Taub Hospital. Ms. Gallegos was declared dead at 3:21 a.m. on January 12, 2015, as a result of the multiple blunt force injuries she sustained in the fatal crash.

Through persistent efforts, the attorneys for the families were able to reach a confidential settlement alleging Chilos was negligent for serving alcoholic beverages after it was apparent to Chilos employees that Sims was obviously intoxicated to the extent that he presented a clear danger to himself and others.

Although the total amount is confidential, the settlement reached provides a just resolution for the family.
