Lawsuit Filed After Pappas Restaurant Land Was Used in Multiple Gun Related Incidents

Houston, Texas (June 26, 2023) — Houston-based law firm Abraham, Watkins, Nichols, Agosto, Aziz & Stogner partner Mo Aziz and attorney Angelina Wike, along with co-counsel attorney Nicholas Giles, have filed suit against multiple defendants related to TABÚ nightclub in Houston, Texas after numerous reported gun-related incidents on the defendants’ premises. The most recent incident took place on June 11, 2023, when victim, Mr. Simeon Harvey, was shot three times—in his abdomen, his back and in one leg. As a result of the shooting incident, Mr. Harvey sustained catastrophic injuries, has undergone multiple major surgeries and remained hospitalized until he was discharged Sunday evening after nearly two weeks.

The defendants named in the lawsuit are alleged to have disregarded multiple violent crimes and similar shootings on the premises, as reported by the Houston Police Department. The lawsuit alleges premises liability, negligence, and gross negligence and seeks damages of over $1,000,000.00.

At the time of the violent shooting involving Mr. Harvey, TABÚ and its premises was managed, maintained, operated, and/or used by defendants J&R Weber Investments, LLC, The Luxury Financial Group, LLC, and Michael Collins. Defendant PHCG Investments was the owner of the land known as 6003 Richmond Avenue, Houston, Harris County, Texas, 77057, upon which TABÚ was occupied.

Because of the frequent and ongoing violent crimes taking place on the premises since January of 2022, the city of Houston has also filed a lawsuit against the various defendants and seeks to have TABÚ shut down.

Attorney Mo Aziz added, “These establishments that operate in late-night environments have a duty to secure the premises and ensure the visitors are safe. Far too often we see these repeated failures occur and go unpunished. The defendants have been aware of the long-standing history of violent criminal activity occurring on its premises, yet they have failed to implement adequate security measures to deter this type of activity.”
