Houston Law Firm Of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner Will Host A Press Conference At 10:30 A.M. On Wednesday, July 22, 2015, To Discuss A Lawsuit Filed Against Three Texas Defendants.

(Houston, TX) Firm Partner Benny Agosto, Jr. has filed a lawsuit on behalf of the family of Ronald Burdick against Dionnica Porter, leasing agent and driver of the golf cart, Dolce Living Rosenberg, LLC, the apartment complex, and Pace Realty Corporation, the property management company, for the fatal injuries Mr. Burdick sustained after being thrown from a golf cart at the Dolce Living Rosenberg property on May 7, 2015. After being hospitalized at Memorial Hermann Hospital for eight days, Mr. Burdick did not survive his injuries and died on May 15, 2015.

In May, Mr. Burdick and his wife visited the Dolce Living Rosenberg property in search of a new apartment. The couple had just moved from Alaska, and the Dolce Living Rosenberg complex was one of the first properties they were interested in. After being greeted by Ms. Porter, leasing agent for Dolce Living Rosenberg, the couple described to Ms. Porter the type of apartment that best suited their needs. Ms. Porter offered to show the couple a few model apartments she had in mind for them and told them that she would use the property’s golf cart, which was frequently used to travel within the apartment complex. Mrs. Burdick sat in the front seat with Ms. Porter, while Mr. Burdick sat in the rear seat. Ms. Porter reversed the golf cart and began driving towards one of the property’s gates, when suddenly and without warning, made an unexpected tight left turn, ejecting Mr. Burdick from the golf cart and onto the pavement. Mr. Burdick suffered a serious brain injury as a result of the forceful fall and died days later.

Ms. Porter, an employee of Dolce Living Rosenberg and Pace Realty Corporation, was acting as an agent for her employers, and was within the course and scope of her employment, when the catastrophic injury occurred. Firm Partner Benny Agosto, Jr. is seeking to hold Ms. Porter, Dolce Living Rosenberg, and Pace Realty Corporation liable for negligence, in causing the untimely and unfortunate death of family man, Mr. Burdick. The couple had decided to move to Texas to be closer to their children and grandchildren, after Mr. Burdick retired from his years of service in the Air Force and Department of Defense.

Mr. Agosto is also seeking full compensation for the injuries sustained by Mrs. Burdick in witnessing her husband’s serious and fatal injuries, and for loss of consortium. Mr. Burdick’s children, who have been robbed of the care and companionship of their father, will also seek compensation for their loss.
