Houston, Texas (January 22, 2024) — Managing Partner Benny Agosto Jr. and attorney Ben Agosto III of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner have filed a petition on behalf of Florida Castillo, the representative of the estate of Yuliana Castillo. The plaintiffs also include her brother Jonathan Castillo and father Oswaldo Castillo. The petition was filed against Pinnacle Propane, LLC, and Daniel Dunbar, the driver of the defendant’s vehicle. The lawsuit is asking for $150 million for damages, citing negligence, gross negligence, negligence per se, survival action, bystander claim, and wrongful death.

On January 8th at 1:15 pm, Florida Castillo’s children, Yuliana and Jonathan Castillo, were driving on FM 2920 in Spring, TX. Mr. Dunbar, driving on the opposite side of the road, failed to control his speed when traffic was slowing. Mr. Dunbar also failed to notice the change in traffic speed and was traveling at a recklessly excessive speed under the circumstances. Other cars in Mr. Dunbar’s Lane and direction of travel were able to adjust for the change in speed and slow down without causing a collision. When he attempted to stop, because of his excessive speed, he began to skid. Video evidence shows that Mr. Dunbar crossed the median into oncoming traffic, where he slammed into the plaintiffs’ car, who had no warning before the impact. The collision was so severe that the plaintiffs’ car spun counterclockwise off the road and into the adjacent ditch. Because of Mr. Dunbar’s speed at impact, the Pinnacle truck did not stop and went on to strike a parked commercial truck and trailer.

As a result of the crash, Jonathan Castillo was severely injured and was rushed to the hospital by ambulance. Jonathan sustained whiplash injuries, a fracture of his humerus, among other injuries for which he continues to receive treatment. Jonathan’s sister Yuliana was killed at the scene, and Jonathan watched as his sister died.

Yuliana was born in Spring, TX, on July 7, 2004. She graduated from Carl Wunsche Sr. High School, where she participated in the Spring Tri Club and the FFA. She had a passion for taking care of animals and often volunteered with her friend at an animal shelter and at Weavers of Love in Kingsville, TX. Yuliana was pursuing her second year in Chemical Engineering at Texas A&M University, Kingsville. She is survived by her parents, Florida and Oswaldo, her brother, Jonathan, grandparents, Alfonso and Florida Chicas, her Abuelita Teresita Del Niño Jesus Rodríguez, her aunts and uncles from Houston and Ecuador, and many loving cousins.
