(Houston, TX) Texas attorney Benny Agosto, Jr. of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner is representing Hugolina Guerrero de Garzon and Joselin Damian Gonzalez for catastrophic life-threatening burns to over 75% of their bodies as a result of a floor collapse at a Church’s Chicken in Livingston, Texas. The incident occurred on August 1, 2016, when the floor beneath the workers collapsed, causing a deep fryer to fall on top of them, spilling hot oil over their bodies. Both plaintiffs suffered serious and permanent injuries and are still hospitalized.

“This is the worst case I have ever seen, with absolutely horrifying life-long injuries,” Agosto said. The lawsuit was filed in Polk County against Triangle Capital Properties, LLC, CT Restaurants, L.P., and Store Master Funding VIII, LLC-the owners, operators, managers and/or controllers of the Church’s Chicken. The lawsuit alleges these companies failed to maintain a safe work environment for the workers, failed to properly inspect and maintain the premises, and failed to remedy a known dangerous condition. Plaintiffs are seeking $150 million dollars in damages.
