Man Sues LA Fitness After Faulty Gym Equipment Causes Injuries

On January 7, 2022, a man (“Man”) filed a complaint against LA Fitness in Harris County District Court after suffering injuries caused by a piece of faulty gym equipment.

The Man filed his lawsuit against Fitness International, LLC (hereinafter “LA Fitness”). The Man asserts causes of action for negligence, premises liability, and gross negligence against LA Fitness as a result of an incident that caused him to suffer bodily injuries.

According to the lawsuit, the Man was an invitee and guest at LA Fitness and while working out on the elliptical device, was injured when the elliptical’s right pedal snapped off the device causing him to fall forward. The fall from the device caused the Man to sustain bodily injuries to his hip, head, leg, and back.  

In his lawsuit, the Man alleges that LA Fitness provided faulty and/or unfit equipment and that it further failed to properly train and/or supervise staff to inspect the premises to discover dangerous conditions such as those presented by the elliptical device. He claims LA Fitness failed to provide any safety instructions with regard to his use of the elliptical device.

The Man claims LA Fitness failed to properly train its employees, failed to properly supervise employees, failed to provide a safe facility for visitors and other invitees, and failed to inspect for, and correct, dangerous conditions on the premises.

The Man further alleges that LA Fitness was negligent in that it failed to warn gym invites of the dangerous condition presented by the elliptical device and that LA Fitness knew or should have known that the elliptical device was in an unreasonably dangerous condition. 

The Man also alleges LA Fitness had a duty to keep and maintain the premises in a safe condition. The Man claims he was an invitee who entered the LA Fitness premises for the benefit of LA Fitness and that LA Fitness had a duty to either warn the Man of the unreasonably dangerous condition or to make the unreasonably dangerous condition reasonably safe. As a result of its failures, the Man claims LA Fitness breached its duty and standard of care it owed to him and caused his injuries.  

The Man seeks monetary relief for damages resulting from, among others, medical expenses both past and future, physical pain and suffering both past a future, and mental anguish, among others.
