Arbitration Under Fire by Billionaire

Lawyers, including myself, have long complained of the unfairness of the mandatory arbitration process. Touted by many businesses as a better alternative to be jury trial process, those who oppose the mandatory arbitration system generally have a long list of inequities to parade as exhibits to support their arguments. Now, Microsoft co-founder Paul Allen and his investment company, Vulcan Capital, are jumping on the bandwagon to criticize the mandatory arbitration process. The little guys -- usually a credit card consumer or the mammoth sized company employee -- are ready to applaud the billionaire's decision to remove mandatory arbitration agreements from his Vulcan employee contracts.

"Proposed Changes to Disciplinary Rules May Make it Harder to Withdraw from Cases

The recently proposed changes to the disciplinary rules have modified the enumerated reasons a lawyer can withdraw from representation. Under current rule 1.15 a lawyer is specifically allowed to withdraw if a client fails to pay the lawyer's fee. Under the proposed rule this specific basis has been removed. Although not in effect yet, this could cause major issues for attorneys who bill for their services on an hourly basis or flat fee. The final version of the proposed rules should be available very soon.

Getting Charged For Medical Bills You Never Saw Coming

In early 2009, I underwent a medical procedure. I had spoken with the doctor and hospital regarding how much I will need to pay and how much my health insurance would pay for the procedure. I was given the amounts. A couple of months after the procedure, I received a bill from an anesthesiologist for several thousand dollars. I was of course surprised and disappointed-this anesthesiologist was not covered under my health insurance plan and I was stuck paying this bill. This is called balance billing.

Teen Drivers At Higher Risk Of Accidents

According a report from the National Highway Traffic Safety Administration, in 2007, young rivers (those between the age of 15 and 20) accounted for close to 1/5th of all traffic accident fatalities in the country. Those drivers made up just 9 percent of the national population in 2007, but accounted for 19 percent of traffic fatalities the same year. Those rates must be taken as a wakeup call by our law enforcement agencies - they need to focus harder on this vulnerable section of the Texas population.

Do Caps on Damages Bring In Doctors? NO!

The most recent data released from the American Medical Association shows there are more doctors in the United States than ever. Additionally, there are more doctors per capita in the U.S. than ever before. Tort reform advocates have long taken the position that without legislatively produced caps on damages, doctors will flee states until caps are put in place. With this recent release of data, that theory can be tested - and has been tested.

Cold Weather Safety Tips

With weekend temperatures expected to be low across the country it is a good idea to protect yourself and help others who may be at increased risk of health problems from the cold. Seniors, infants, the homeless, and those with chronic medical conditions are at increased risk. If you know of friends, neighbors, or family members who may be at risk check in on them to sure their heat is working and that they are OK.

18. Forget issues of the past. Don't remind your partner with His/her mistakes of the past. That will ruin your present.

20. Make peace with your past so it won't weight the present.

22. Realize that life is a school and you are here to learn. Problems are simply part of the curriculum and fade away but the lessons you learn will last a lifetime.

Head-On Collision Results in Serious Injuries but Victims are Happy to be Alive during Holidays

On Christmas Eve, a father, his daughter and the daughter's husband were driving on a two way road when the car coming the opposite direction entered their lane and hit them head-on. The daughter was taken to the hospital by helicopter, suffering from a severe broken left leg. The father and son-in-law each suffered from fractured backs. The family immediately called me to help and I quickly arrived at the hospital. I actually had to visit three hospitals as they were taken to three different hospitals. Their family of course also visited all three hospitals. It was at the last hospital that I realized that their family would be apart during Christmas. A family member put things in perspective--she said that considering all the damage to the vehicles, they were just happy to have their family members alive. After leaving the hospitals and arriving home late, I made sure to tell my family that I am thankful that they are in my life. I wish everyone happy holidays

Motor Vehicle Tires Pose Safety Risk

The tires that we depend upon to safely travel in our cars and trucks can pose safety risks to motorists. Tires are constructed of multiple layers. The layer which makes contact with the roadway can separate ("delaminate") from the rest of the tire under certain conditions. And a catastrophic failure of this type can lead to collisions which cause extreme bodily injury or death to the passengers in the vehicle whose tire failed, as well as to other users of the highways. The principal difficulty is to construct a method or substance to hold the rubber components in a tire to the steel components, which are used in steel-belted radial tire. When this adhesion fails, the tread may separate from the rest of the tire and produce disastrous consequences. That is especially true because heat may degrade the adhesive design, and heat is intensified at highway speeds, or in the summer, or in a combination of the two.
