Wrongful Death Suits Filed Against Railroad

The widow of a Union Pacific Railroad engineer who died in a train collision last October filed a wrongful death lawsuit against the company after an apparent mechanical brake malfunction. On the day of the incident, engineer Jason Martinez's train was heading east to North Platte, Nebraska, when the train's crew realized the brakes were malfunctioning. The crew alerted Union Pacific Railroad dispatch center and informed them that the train had accelerated to 50 mph and was unable to stop. The train ultimately collided with another train that was stopped on the tracks about 18 miles west of Cheyenne, Wyoming. No one was in the stopped train at the time of collision.

A 24-year-old Fort Worth man tragically died in a vape store parking lot this January after his vape pen exploded in his face. After the explosion, the man was taken by ambulance to the hospital where he later died.

Wrongful Death Suit Filed Against Senior Living Facility

A man in Santa Fe, New Mexico has filed a lawsuit against Pacifica Senior Living for the death of his father, Julian Gaul. In February 2017, the staff found the 83-year-old man lying on the floor between his wheelchair and bed, and transported him to Christus St. Vincent Regional Medical Center. The man's son, Fred Gaul, was told by a doctor that blood had been collecting in his father's brain for some time, likely from an earlier fall. Less than 24 hours later, Gaul was found on the floor again and was taken to the hospital and treated for a broken nose and wide gash across his forehead that required six stitches. Sores were discovered in his groin region along with fungus growing on his genitalia from not being cleaned for months. Gaul died three days later.

$37.6 Million Verdict Against Honda in Defective Seat Belt Lawsuit

On February 13, 2019, a Texas jury returned a $37.6 million verdict against Honda, finding that the seat belt system in a Honda minivan had a design defect that left a woman paralyzed after the vehicle was involved in a rollover crash.

New Taskforce Targets Unsafe Drivers on Houston Roads

After last year's Houston Chronicle investigation, "Out of Control," local law enforcements have responded with the establishment of a regional task force to better patrol the roads. The article identified that "more than 600 motorists, passengers and pedestrians die every year in traffic collisions often caused by drivers who are speeding, driving while intoxicated or distracted and often on poorly designed roads", ranking Houston roads among the nation's deadliest. The article also criticized local law enforcements for their lack of a comprehensive strategy to lower the number of traffic accidents, and even lowering the number of enforcements in certain regions where fatal accidents rose. However, Harris County Sherriff Ed Gonzales is hopeful that the creation of the new task group which aims to crack down on traffic violations and unsafe drivers will help keep the roads safer for Houstonians. Sherriff Ed Gonzales stated that "we want to make sure we're visible and not just performing spot enforcement, and make it more sustainable."

Faulty iPad Battery Ignites and Causes Death

In February of 2017, Bradley Ireland, then 64 years-old, suffered severe injuries after his apartment caught fire. He died later that day. Julia Ireland Meo, Mr. Ireland's daughter, has sued Apple and alleged that the fire started due to a faulty battery pack in an iPad. According to the suit, "The fire was caused by a defect in the subject tablet, specifically affecting the tablet's battery pack." The fire started in Mr. Bradley's kitchen.

It's Time to Check Your Tires

The National Highway Traffic Safety Administration reports that more people are killed in motor vehicle accidents due to faulty tires than in accidents caused by distracted driving. The NHTSA reports that 738 people died in 2017 from accidents caused by tire-related issues. Compare that to deaths caused by cellphone-related accidents, which has never exceeded 500 people for any year the NHTSA has collected such data. The NHTSA recommends having your tires checked annually. Clearly, ensuring that the tires on our vehicles are in good condition is something we should all take the time to do.

Texas Court Allows Sutherland Springs Victims to Sue Store that Sold Shooter Guns and Ammo

Just over a year ago on November 5, 2017, one of the deadliest mass shootings ever to occur on American soil took place in Sutherland Springs, Texas. The carnage was brought on by a gunman by the name of Devin Patrick Kelly of nearby New Braunfels. In total, 26 lives were lost that day along with 20 others who were injured.

Lawsuits Filed Against Mental Health Facilities for Holding Patients Against Their Will

Several lawsuits have been filed against various mental health facilities across the State of Texas by former patients who claim they were held against their will without cause. According to one lawsuit filed in federal court, nine individuals were held against their will after voluntarily agreeing to seek treatment at various mental health facilities including Mayhill Behavioral Health, Millwood Hospital, DeSoto at Hickory Trail, and Behavioral Hospital of Bellaire. The plaintiffs have alleged that the defendants held them against their will through a series of fraudulent and illegal acts, including falsifying documents to secure detention orders from a judge. The lawsuits also allege that the defendants use intimidation, manipulation, and fear to keep voluntary and involuntary patients from leaving the facilities.
