Golf cart(Houston, TX) On behalf of Yvonne “Bonnie” Herndon, her husband, her twin brother, and her two children, Houston lawyers Benny Agosto, Jr. and Brant J. Stogner have settled the lawsuit seeking compensation for the serious, life-changing injuries Bonnie Herndon received after being thrown from a modified and defective golf cart at the Houston Livestock Show and Rodeo in early 2013. Bonnie Herndon has been hospitalized and in a coma since the incident on February 25, 2013.

Bonnie Herndon and her husband attended the Toby Keith concert that was put on in conjunction with the 2013 Houston Livestock Show and Rodeo on opening night. After the show ended, the couple utilized the golf cart transportation service to return to their parked vehicle; Bonnie Herndon was in the front seat with the driver and her husband was in the row behind her. The driver, operating on behalf of the Houston Livestock Show and Rodeo, made a quick left turn, ejecting Bonnie Herndon from the modified golf cart where she landed head-first on the pavement of the Reliant Stadium (now NRG) parking lot. Mrs. Herndon suffered a serious closed head injury as a result of the trauma and has remained comatose since.

The Herndons were transported that night by a Rodeo volunteer in a modified and “stretched” golf cart. Prior to the modification, the subject golf cart was purchased by Georgia corporation, Mr. Golf Carts, Inc. Mr. Golf Carts, Inc. modified the subject golf cart from a two passenger vehicle to a six passenger vehicle. In modifying the golf cart, Mr. Golf Carts, Inc. improperly removed the overhead handles, which are designed and placed for passenger containment. Mr. Golf Carts, Inc. also improperly positioned the hip restraint in relation to the seatback for the front-row passenger. The end design resulted in a front-row passenger hip restraint system that failed the industry’s minimum standards for passenger containment and completely lacked overhead handles.

The subject golf cart was purchased from Mr. Golf Carts, Inc. by Conroe Golf Cars, Inc., a local dealership that won the bid to supply the Rodeo with hundreds of golf carts for use during the 2013 Rodeo season. On the night of the incident, the subject golf cart was operated by a young volunteer on behalf of the Houston Livestock Show and Rodeo and the parking lot activities were controlled by SMG, a Pennsylvania general partnership associated with property management. Bonnie Herndon’s family has settled the case against all parties. The total settlement amount is confidential and will provide for Mrs. Herndon’s lifetime care.
