At the conclusion of a trial by Houston attorney Benny Agosto, Jr., of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner, a considerable judgment was rendered in favor of the family of Vilma Marenco for the fatal injuries she sustained after her car was struck by an 18-wheeler truck. On that day, Rodger Jones was operating an 18-wheeler truck which was owned by Defendant Elisa Fabiola Lopez d/b/a R&F Quality Transportation Co., and hauling a trailer loaded with large oilfield pipes. Jones was travelling west in the 15000 block of Beaumont Highway when he failed to stop at a red light, blasted through the intersection at Pineland Road, and struck the driver’s side door of Mrs. Marenco’s car. The impact of the 18-wheeler striking Mrs. Marenco’s car was so severe that medical examiners declared Mrs. Marenco dead at the scene of the crash.

The 11 th District Court of Harris County found that the negligence of both Rodger Jones and Elisa Fabiola Lopez d/b/a R&F Quality Transportation Co. proximately caused the death of Mrs. Marenco, and that each Defendant was 50% responsible for causing the crash at issue in the case. The Court also found that the harm to Mrs. Marenco and her family occurred as a result of the gross negligence of Rodger Jones and Elisa Fabiola Lopez d/b/a R&F Quality Transportation.

Accordingly, the Court rendered judgment against Defendants Roger Jones and Elisa Fabiola Lopez d/b/a R&F Quality Transportation for the following damages: $2,000,000 to Plaintiff Guillermo Gomez (widower), $3,000,000 to Plaintiff Maria Guadalupe Gomez (minor daughter), $1,000,000 to Plaintiff Sonia Marenco Leon (adult daughter), and $5,000,000 to all Plaintiffs in punitive damages.
