(San Antonio, TX) Today a lawsuit has been filed by attorneys Benny Agosto Jr. and Lena Laurenzo of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner against CJ’s Scoreboard Inc. d/b/a Charlie Brown’s Neighborhood Bar & Grill, a local San Antonio establishment, after a male customer, Devin Dipprey, was attacked and physically assaulted by an employee or staff member on September 29, 2018. Mr. Dipprey, pictured below, went to the bar with a friend to enjoy a drink and conversation that evening. After the bar began closing down around 2 am, an employee who represented himself to be the bar manager engaged in conversation with the two patrons. The bar manager became heated from their conversation and ultimately asked Mr. Dipprey and his friend to leave. While they were attempting to leave the bar, without provocation or warning, the bar manager suddenly “sucker-punched” Mr. Dipprey. The punch was so unexpected and violent that Mr. Dipprey lost consciousness. The bar manager then climbed onto Mr. Dipprey and continued to assault him on the ground until others were able to pry the bar manager off.
The lawsuit focuses on the negligence of CJ’s Scoreboard Inc. d/b/a Charlie Brown’s Neighborhood Bar & Grill, its employees, and its staff on the night in question. The bar has since denied the bar manager is a true employee, but a staff member who helps watch the door. Businesses like these have the responsibility to keep patrons safe from their own employees and staff members. Patrons of bars and restaurants should not have to fear being assaulted by employees, and the lawsuit alleges that CJ’s Scoreboard Inc. d/b/a Charlie Brown’s Neighborhood Bar & Grill failed to keep Mr. Dipprey safe.
