(Houston, TX) Houston attorney Randall O. Sorrels of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner has filed a lawsuit against Silverleaf Resorts, Inc., operating company of the Piney Shores Resort in Lake Conroe. The lawsuit alleges that the company was negligent in its design, oversight, and operation of its archery range at one of its properties, causing a serious head injury to a seven-year old child. The lawsuit seeks unspecified damages for both the child and his family for past and future medical expenses, past and future pain and suffering, past and future physical impairment, past and future disfigurement, and future loss of earning capacity. The lawsuit was filed on June 23 in Dallas County, Texas.

The Facts of the Case

The facts of the case are as follows:

  • A seven-year-old boy, Londen Chavez, was injured while celebrating his birthday at Piney Shores Resort, a property operated by Silverleaf Resorts, Inc., the defendant.
  • While at the resort’s archery range, the child was seriously injured while retrieving arrows from the target area when his 12-year-old brother fired an arrow toward the target that pierced Londen’s head. The brother was not aware of Londen’s presence near the target.
  • When the incident occurred, none of the resort’s employees were at the archery range, leaving the activity unmonitored and unsupervised.

The lawsuit charges that the archery range was dangerous in design because it allowed users to pass in front of the targets unseen by those shooting the arrows. It further alleges that the defendant was negligent and thus liable for the injuries resulting from that negligence because it knew or should have known that the design and layout of the archery range was dangerous, but did nothing to make the archery range safe.
