Abraham Watkins Files VW Lawsuit On Behalf Of El Paso County

Firm partners Benny Agosto, Jr. and Mo Aziz of the Houston law firm of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner have been retained by El Paso County to lead a team of lawyers who have filed a lawsuit against Volkswagen Group of America Inc. and Audi of America, LLC. El Paso County filed the lawsuit against the car manufacturer claiming that emissions from more than 1,000 diesel cars circulating on roadways in the region have caused harm to the population and environment of the region. This is yet another lawsuit filed by a government entity against the car company since management admitted to falsifying emissions numbers of certain cars released since 2009.

The El Paso County Attorney’s Office appointed the law firm of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner, to handle this important case. El Paso County is seeking over a million dollars in damages, but that number could increase as more information about Volkswagen’s fraud becomes available.

Although the investigation is still in the preliminary stages, it has already been determined that the following diesel vehicles were installed with the “defeat device” by Volkswagen:

  • Volkswagen Touareg (MY 2009-2016)
  • Porsche Cayenne (MY 2013-2016)
  • Audi A6 Quattro (MY 2014-2016)
  • Audi A7 Quattro (MY 2014-2016)
  • Audi A8 (MY 2014-2016
  • Audi A8L (MY 2014-2016)
  • Audi Q5 (MY 2014-2016
  • Audi Q7 (MY 2009-2016)

El Paso County Attorney Jo Anne Bernal stated, “Texas Law, the Texas Water Code, grants counties the authority to seek civil penalties for certain violations of law.” Remedies available to El Paso County include imposing daily fines up to $25,000 beginning in 2009.

Abraham Watkins is also involved in a consumer class action lawsuit against Volkswagen filed in Cook County, Illinois and in the suit filed on behalf of Harris County, Texas for the emissions violations.
