Mandatory Labor Law Requirements Under the Fair Labor Standards Act (FLSA)

The FLSA was enacted by the U.S. Department of Labor to establish the minimum wage, working hours, overtime rules and exemptions to those regulations. The act is a federal law that governs hour and employment standards for workers.

Under the FLSA, employers must:

  • Pay federal minimum wage (currently $7.25 per hour)
  • Pay time and a half for hours worked over 40 hours a week for nonexempt employees

These laws, of course, vary depending on the specific employer and employee — for example, jobs that earn employees tips sometimes have different rules.
