Mandatory Labor Law Requirements Under the Fair Labor Standards Act (FLSA)
The FLSA was enacted by the U.S. Department of Labor to establish the minimum wage, working hours, overtime rules and exemptions to those regulations. The act is a federal law that governs hour and employment standards for workers.
Under the FLSA, employers must:
- Pay federal minimum wage (currently $7.25 per hour)
- Pay time and a half for hours worked over 40 hours a week for nonexempt employees
These laws, of course, vary depending on the specific employer and employee — for example, jobs that earn employees tips sometimes have different rules.

Employee Rights Under FLSA
An employer must comply with the Fair Labor Standards Act when dealing with working hours, overtime pay, and wage and hour issues that may arise for employees. If you were not paid in accordance with the law, our attorneys can assist you in pursuing a claim against your employer. We will help you establish your claim and collect the payments and wages you are owed.
While the act does exempt some employees from the rules, employers have been known to unfairly misclassify employees as exempt when they are not. We will help you establish that you are a nonexempt employee so that you can lawfully collect wages and overtime that are due.
Our attorneys are experienced and have helped clients with employment law concerns involving:
- The Fair Labor Standards Act
- Wage and hour claims
- Exempt employees
- Nonexempt employees
