Construction Company Faces Proposed Fines for Willful Safety Violations

A federal investigation found a Houston – area contractor willfully disregarded required safety procedures which contributed to a teenager’s death when a 15-foot trench wall collapsed on him near Fulshear in September 2023. The company is now facing more than a quarter million dollars in fines.

Investigators with the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) have determined that Hurtado Construction Co. allowed the 18-year-old to work in the trench without a proper protective system in place to prevent the trench’s collapse. The young man suffered fatal injuries when the trench wall caved in on him, and tons of dirt pinned him against a reinforced concrete box.

Hurtado Construction Co. was previously cited back in November 2021 for failing to use an adequate protective system to prevent employees from a possibly deadly collapse at another excavation worksite in Katy, Texas. Unfortunately, the company has a history of workplace safety failures that includes no less than eight OSHA citations for not providing required protective systems after another worker fatality in January 2007.

The company faces $257,000 in proposed penalties for its violations. Hurtado Construction, which is based in Richmond, Texas, provides water, sewer, and stormwater line installations and repair.
