$745M for Family After Daughter Killed by Driver

On September 8, 2023, a 25-year-old woman was on the sidewalk leaving work when a driver in a SUV struck and killed her. Before the crash, the driver of the SUV had huffed nitrous oxide. The woman’s parents sued the driver of the SUV, the smoke shop that had sold the nitrous oxide to the driver, and the distributor of the nitrous oxide, Whip-It!.

The two-week trial focused on whether the company that distributes nitrous oxide under the name Whip-It! conspired with a smoke shop to sell the product, nitrous oxide, to customers they knew intended to illegally inhale the gas to get high. The family’s lawyer said Whip-It! is sold as a food propellant to make things like whipped cream, but evidence at trial showed that a large portion of its business model relies on selling the gas to smoke shops.

The Missouri jury awarded $745 million, finding the driver only 10% liable, the smoke shop 20%, and the distributor 70%.
