Woman Sues Fitness Center After Sauna Bench Causes Injuries

On April 19, 2023, a woman (“Woman”) filed a lawsuit against Roman Empire Fitness Center in Galveston County District Court after suffering injuries caused by a faulty or defective sauna bench.

The Woman asserts causes of action for negligence, negligence per se, negligent retention, negligent hiring, negligent training, premises liability, and gross negligence against Roman Fitness as a result of an incident that caused her to suffer severe bodily injuries.

According to the lawsuit, on January 11, 2023, the Woman was an invitee and guest at Roman Fitness in League City, Texas and while sitting on a bench in the sauna area of the fitness center, the bench became unhinged from the wall and caused her to fall. As a result of the fall, the Woman sustained injuries to her head, shoulders, back, arms, and legs.

In his lawsuit, the Woman alleges that Roman Fitness failed to warn of the dangerous condition presented by the sauna bench, failed to inspect the fitness center premises, and failed to properly warn of the hazardous nature of the sauna bench. 

She claims Roman Fitness failed to properly train its employees and enforce proper polices to make the fitness center premises safe. The Woman further alleges that Roman Fitness also failed to fix, repair, or replace the sauna bench in a reasonable and timely manner which caused her to suffer pain, impairment, and disfigurement as well as forcing her to incur hospital, physician, and pharmaceutical bills. 

The Woman also alleges Roman Fitness had a duty to keep and maintain the premises in a safe condition because she was an invitee who entered the fitness center premises for the benefit of Roman Fitness and that it had a duty to either warn the Woman of the unreasonably dangerous condition or to make the unreasonably dangerous condition reasonably safe. As a result of its failures, the Woman claims Roman Fitness breached its duty and standard of care it owed to her and caused her injuries.  

The Woman seeks monetary relief for damages resulting from, among others, medical expenses both past and future, physical pain and suffering both past a future, and mental anguish, among others.
