On March 7, 2023, a dry-cleaning store employee (“woman”), filed a complaint in the Harris County District Court against defendant My Ha, LLC doing business as Dry Clean Planet #10 (“Defendant”) for injuries she sustained while working for Dry Clean Planet #10 in Spring, Texas (“Incident”).
On December 2, 2022, according to the lawsuit, the Incident occurred while the woman, a Harris County resident, was working for Dry Clean Planet #10. The woman had been using the jean iron press machine, when the top part of the machine suddenly fell on her head, causing the woman to suffer serious injuries.
The woman claims that the Defendant was negligent in failing to properly train her, failing to give her supervision and for failing to inspect her work area. Moreover, the woman alleges, the Defendant failed to give her reasonably safe and suitable tools and failed to maintain their equipment.
The woman seeking damages and compensation for her past and future medical expenses; past and future physical impairment; past and future pain, suffering and mental anguish; past and future physical disfigurement; and past and future loss of earning capacity, among other damages. The woman has sued the Defendant under theories of negligence and premises liability. In her petition, the woman alleges Defendant is responsible for her injuries because the Defendant failed to correct and/or reduce and/or eliminate the unreasonable risk of harm caused by the dangerous condition; failed to establish and enforce rules and regulations for the workers and supervisory personnel to follow; failed to maintain the equipment, appliances, and machinery in safe condition; and further failed to warn her about the dangerous condition.
The woman is seeking monetary relief in an amount between $250,000 and $1,000,000.
