Benzene in Aerosol Products

Figure 1 – 10 of the recalled dry shampoos

In October of 2022, a voluntary product recall was issued for select aerosol dry shampoo brands produced prior to October 2021 due to the presence of unsafe levels of benzene. The potential elevated levels of benzene could be found in aerosol dry shampoo cans manufactured by Dove, Nexxus, Suave, TIGI, and Tresemme. Benzene is a human carcinogen, which – if exposed – can cause leukemia, blood cancer, and blood disorders. The FDA recommends that consumers stop the use of the affected dry shampoo products and to look over the list of UPC codes, which can be found here.

No injuries or deaths have been reported to date with this recalled product. However, given the high levels of benzene in these products, they may occur.

If you or a loved one have purchased and used these aerosol products, you may be entitled to compensation under a product liability claim. It is important for consumers to understand the different types of product liability claims that are available in Texas. Product liability claims can be divided into three main categories: strict liability, negligence, and breach of warranty. Strict liability claims cover when a product has a manufacturing or design defect that results in injury to the user. Negligence claims cover when the manufacturer or seller of the product failed to exercise reasonable care in designing, making, or marketing their product. Lastly, breach of warranty claims cover when a company fails to stand by their promises regarding their product’s performance, quality, or safety.
