Woman Sues Health Clinic After Trip and Fall

On September 7, 2022, a 92-year-old woman filed a petition in the Harris County District Court against Houston health clinic Plan B-MOB LP and Healthcare Realty Holdings LP, as a result of injuries she sustained while entering the building. The woman asserts causes of action for premises liability and negligence against the health clinic.

According to the lawsuit, on May 31, 2022, the woman was visiting the defendants’ medical clinic on Fannin Street in Houston, Texas. The petition states that, as the 92-year-old woman entered the building through the revolving door, another patron pushed the door at a high rate of speed. The woman claims that this impact caused her to fall to the ground and break her hip. She claims that the revolving door had no mechanism of slowing down when pushed at a high rate of speed, which makes it hard for the elderly to enter and leave the building.

In the lawsuit, the woman alleges Plan B-MOB LP and Healthcare Realty Holdings LP knew of the danger on their premises and failed to act in a way that would protect her or warn her of the danger. She also alleged that they were negligent in that they failed to inspect their premises and fix the dangerous condition.

The woman claims that at the time of the incident in question, the clinic had a duty to keep and maintain its premises, including the revolving door, in a safe condition. Due to the condition of the revolving door, the woman claims the clinic’s premises was not safe.

She now seeks monetary relief and compensation for damages resulting from the accident including the medical expenses she incurred. She has also requested a trial by jury and all other just relief.
