A trucking company is liable for the death of one man in Houston after a tire flew off a large truck while driving on I-45 North. The accident occurred on the busy interstate near Louetta and caused a traffic backup for miles. The cause of the tire coming loose is unknown, but negligence is clearly involved.

Trucking companies owe the public duty when they transport objects that can cause injury. Heavy objects such as spare tires, or truck loads of new tires must be properly secured. Trucking companies that fail to properly secure their load can be held liable for their failure.

All too often the negligence of trucking companies and truck drivers causes injury and death on the roads. Trucking companies have a duty to properly train their drivers. This includes training on proper strapping and tie-down of objects being transported that have the potential to dislodge or fly off.

In the incident that occurred Thursday, the driver died at the scene, and his son who was in the back seat survived. This tragic incident was preventable with the proper training and precautions. Had the truck company and truck driver acted in a diligent manner, a son would not have lost his father. Now the truck company is liable for the wrongful death of the father, the trauma and injuries suffered by the son, and more.
