On June 6, 2022, a Harris County resident, and hospital worker (“woman”), filed a complaint in the Harris County District Court against defendant Advanta-Kleen Sealcoat and Striping (“Defendant”) for injuries she sustained while walking through the parking garage after leaving work at the hospital (“Incident”).
On January 17, 2021, according to her petition, the woman had just left her shift as a nurse at the hospital when the incident occurred. The woman claims that the Defendant’s crew members were drilling into the garage floor above where she was walking and alleges the drilling caused large pieces of concrete to suddenly fall from the ceiling and onto her head. Moreover, the woman alleges, Defendant failed to post warning signs about the drilling, failed to barricade the area, and failed to properly train its work crew. The woman further asserts that Defendant was negligent in that it failed to implement adequate safety measures, or enforce existing safety protocols, while its crew members were drilling. The woman claims the falling concrete caused her to sustain serious head and neck injuries.
The woman seeking damages and compensation for her past and future medical expenses; past and future physical impairment; past and future pain, suffering, and mental anguish; past and future physical disfigurement; and past and future loss of earning capacity, among other damages. The woman has sued the Defendant under theories of negligence and premises liability. In her petition, the woman alleges Defendant is responsible for her injuries because the Defendant failed to correct and/or reduce and/or eliminate the unreasonable risk of harm caused by the dangerous condition and further failed to warn her about the dangerous condition.
The woman is seeking monetary relief in the amount of over $1,050,000.
