Convenience Store Sued after Armed Robber Shot and Killed Female Employee  

On March 22, 2022, a petition was filed to initiate a lawsuit in the Harris County District Court against GPM Investments (hereinafter “E-Z Mart”) and Counterforce as a result of fatal injuries sustained by a female employee. The lawsuit asserts causes of action for premises liability and negligence against E-Z Mart as a result of the shooting incident (“incident”) that resulted in the death of an employee.

On July 29, 2020, according to the lawsuit, a 40-year-old female employee lost her life while working for E-Z Mart. The female employee was shot and killed while working alone at the convenience store at approximately three o’clock in the morning when an armed robber demanded money and lottery tickets.  The female employee’s family brought the lawsuit on her behalf alleging E-Z Mart’s negligence and wrongful acts were the proximate cause of her death. The lawsuit asserts that this particular incident was not the first instance wherein an E-Z Mart employee had died as a result of a workplace incident. Allegedly, there were several notable security deficiencies and problems that should have been resolved and/or rectified thereafter—but were not. 

In the lawsuit, various negligent acts are alleged including but not limited to: failure to furnish a reasonably safe workplace; failure to provide adequate safety policies and rules for the safety of employees; failure to maintain and provide adequate security; failure to maintain and provide sufficient on-site security personnel; failure to have adequate policies and training related to robbery prevention and protection of employees from violent acts in the workplace; and failure to have additional staff and/or safety precautions for workers who work late night duty; among many others. The family seeks to recover the loss of companionship, loss of consortium, mental anguish, and other damages. The family further alleges that E-Z Mart was grossly negligent and should be liable to pay exemplary and punitive damages as a result.
