On February 8, 2022, a Harris County resident filed a petition to initiate a lawsuit in the Harris County District Court against Gringo’s Mexican Kitchen and Ybarra Franchising Group LLC (hereinafter “Gringo’s”) as a result of injuries he sustained while leaving the restaurant. The man asserts causes of action for premises liability and negligence against Gringo’s as a result of a trip and fall incident (“incident”) he sustained in the parking lot that caused him to suffer injuries.
On September 30, 2021, according to the lawsuit, the man visited the Gringo’s located on West Grand Parkway in Katy, Texas. The petition states that, as the man was leaving Gringo’s, he tripped on an “unmarked wooden concrete expansion joint” that was protruding upwards between two concrete slabs in the parking lot. The man claims the fall caused him to crash down onto the concrete and his knee, causing him to sustain serious bodily injuries and damages, including but not limited to a fracture, a dislocated and relocated kneecap requiring several surgeries, severe pain, impairment, and mental anguish.
In the lawsuit, the man alleges Gringo’s was negligent in that it failed to properly maintain and/or inspect the parking lot, it failed to give adequate warning of the hazardous condition, it failed to implement proper safety protocols and it failed to make its premises safe for guests.
The man claims that at the time of the incident in question, Gringo’s had a duty to keep and maintain the premises, including the parking lot, in a safe condition. Due to the condition of the parking lot, the man claims the premises and parking lot at Gringo’s were not safe.
He now seeks monetary relief and compensation for damages resulting from the medical expenses he has and likely will incur, his past and probable future pain and suffering, disfigurement, impairment, and mental anguish, among others.
