$110m Jury Verdict Against 3M in First Wave of Defective Earplug Trials

Litigation against 3M has been ongoing for years after numerous individuals, mostly members of the military, suffered hearing loss while using 3M’s earplugs. In fact, the litigation involves over 250,000 individuals who suffered hearing loss and is the largest class-action lawsuit in history.

In late January 2022, the first round of 3M earplug trials concluded. The final trial in this first round of trials involved two combat veterans who suffered hearing loss despite using 3M’s earplugs. After 11 days at trial, a federal jury awarded those two veterans $110 million in damages against 3M as compensation for the permanent hearing loss they suffered as a result of 3M’s defective earplugs. The $110 million was comprised of $15 million in compensatory damages and $40 million in punitive damages being awarded to each of the veterans.
