On November 30, 2021, a Harris County resident filed a petition to initiate a lawsuit in the Harris County District Court against The Farmers Group LLC doing business as Farmers Fresh Meat (hereinafter “Farmers grocery store”) as a result of injuries she sustained while grocery shopping. The woman asserts causes of action for premises liability and negligence against FARMERS as a result of a slip and fall incident (“incident”) caused by a leaky refrigerator on the grocery store floor premises.
On September 23, 2020, according to the lawsuit, the woman visited the Farmers grocery store located at 8630 Cullen Blvd., Houston, Texas 77051. The petition states that the woman was an invitee of the Farmers grocery store and while inside, she slipped and fell in an area where water had accumulated as a result of the leaky refrigerator. The woman claims the fall caused her to sustain serious bodily injuries and damages.
In the lawsuit, the woman alleges Farmers grocery store’s negligent actions and omissions on the premises at the time of the incident were a proximate cause of the incident, including her injuries and damages resulting from the incident. Specifically, the woman claims Farmers grocery store failed to properly maintain the refrigerator, allowed it to remain in disrepair, and further allowed it to leak water onto the floor and walkway of the grocery store floor and the area where she ultimately slipped and fell. Further, the woman alleges, Farmers grocery store failed to adequately warn or make safe the area where the refrigerator was leaking and/or had leaked water.
At the time of the incident in question, Farmers grocery store had a duty to keep and maintain the premises in a safe condition. Due to the condition of the leaky refrigerator and the water it leaked onto the floor, the condition of the grocery store premises was not safe.
The woman seeks monetary relief for damages resulting from, among others, medical expenses both past and future, past and future pain and suffering, disfigurement, impairment, and mental anguish, among others.
