Galveston County Man Killed in Drunk Driving Accident

On or about March 30, 2019, a Galveston County man was walking south on the improved shoulder of the 1800 block of Highway 3 in Dickinson, Texas when a woman driving a Ford F150 swerved off the road, into the shoulder, and struck Decedent. At the time of the collision, the female driver was under the influence of alcohol and legally over the Blood-Alcohol Content (“BAC”) limit to be driving. The woman had been over-served alcoholic beverages by Jeff and Hugh’s Car Wash and Grill in League City just prior to the incident.

The force of the collision caused the Galveston County man to fly through the air and hit the pavement coming to his final resting place some distance from the collision site. The deceased man’s family is now suing the drunk driver and Jeff and Hugh’s Car Wash and Grill for the death of the man.

Establishments like Jeff and Hugh’s Car Wash and Grill can be held liable for the actions of overserved patrons. While the actions of the intoxicated woman can lead to civil liability and criminal charges, the establishments that willingly overserve the public can also be held civilly liable.
