Woman Sues HEB After Slip and Fall Due to Grapes at Checkout Line

On May 12, 2021, a Harris County resident filed a complaint in the Harris County District Court against HEB LP, f/k/a HEB GROCERY COMPANY, LP (hereinafter “HEB”). The woman asserts causes of action for premises liability and negligence against HEB as a result of a slip and fall incident (“incident”) caused by grapes on the floor by the checkout line.

According to the lawsuit on May 27,2019, the woman visited the HEB grocery store located at 12009 Northwest Freeway, Houston, Texas 77092. The petition states that, while inside the HEB, the woman was walking toward the cashier stations when she slipped and fell on grapes that were on the floor. The woman claims the fall caused her to sustain serious bodily injuries and damages.

In the lawsuit, the woman alleges HEB negligent actions and omissions on the premises at the time of the incident were a proximate cause of the incident, including her injuries and damages resulting from the incident. Specifically, the woman claims HEB failed to uphold safety standards in the area where she slipped and fell. Further, the woman alleges, HEB failed to adequately warn or make safe the area where the grapes were present.

At the time of the incident in question, HEB had a duty to keep and maintain the premises in a safe condition. Due to the condition of the grapes on the floor, the condition of the grocery store premises was not safe.

The woman seeks monetary relief for damages resulting from, among others, medical expenses both past and future, past and future pain and suffering, disability and impairment, and mental anguish, among others.
