18-Wheeler Settlement For Back Surgery Plaintiff

Benny Agosto, Jr. and Lena B. Laurenzo recently settled a commercial vehicle crash involving an 18-wheeler company out of El Paso, Texas.

A Texas man was driving his cousin and her children along Interstate Highway 20 near Farm Road 2087 in Gregg County, Texas. While traffic began to slow down ahead, the Texas man slowed his vehicle down in response to the traffic conditions. Suddenly, the car he was driving was rear-ended by an 18-wheeler. Three individuals inside of the vehicle were injured as a result of the crash. Though two of the injured passengers were able to settle their claims without a lawsuit, the Texas man was forced into a lawsuit when the insurance company for the trucking company would not cover his medical expenses.

Mr. Agosto and Ms. Laurenzo went straight to work on the case. They investigated the trucking company thoroughly and found concerning information about the company’s operating history. During the course of the lawsuit, Ms. Laurenzo was particularly focused on the truck driver’s driving as well as the trucking company’s compliance (or lack thereof) with the Federal Motor Carrier Safety Regulations. Interstate trucking companies, or companies that haul loads across state lines, have to comply with these regulations. The primary purpose of these federal regulations is to reduce crashes, injuries, and fatalities involving large trucks and buses.

While Mr. Agosto and Ms. Laurenzo were working hard on the case, the injured Texas man was able to receive necessary treatment for his injuries. His medical care included two back surgeries, among other necessary treatment and procedures. The case was able to resolve with a large and confidential settlement amount for the injured Texas man.
