Child Injured by Metal Spike at Paint Ball Facility

On January 22, 2021, two Montgomery County residents (“parents”) filed a lawsuit in the Harris County District Court against Balls & Bruises Inc. (hereinafter “Balls & Bruises”) on behalf of their minor child (“minor child”). The parents assert causes of action for premises liability, negligence and respondeat superior against Balls & Bruises as a result of an incident that caused injuries their minor child.

December 20, 2020, according to the lawsuit, the minor child visited Balls & Bruises to attend a birthday party of another child. The minor child was seriously injured while playing paint ball on the inflatable walls course due to a metal spike sticking out on the ground of the paintball course. In their lawsuit, the parents allege that Balls & Bruises failed to place warning signs or barriers to alert or notify the minor child, and the public, of the existence of the dangerous condition on its premises. The parents further allege that the owner of the facility admitted he knew the metal spikes had been “popping up” due to the rain. Despite knowledge of the dangerous condition, the owner and Balls & Bruises’ employees failed to follow through with appropriate mitigating measures such as placing warning signs or barriers to alert customers of the facility. The metal spike caused the minor child to sustain serious bodily injuries.

At all times necessary, Balls & Bruises had a duty to keep and maintain the premises in a safe condition. As a result of the metal spikes sticking out of the ground, the condition of the paintball facility premises was not safe.

The parents, on behalf of their minor child, seek monetary relief for damages resulting from, among others, medical expenses both past and future, physical pain and suffering both past a future, physical impairment/loss of enjoyment of life both past a future, disfigurement both past a future and mental anguish, among others.
