Settlement Reached Following Fatal Polaris ATV Accident

Firm attorneys Benny Agosto, Jr. and Michelle Rice settled a lawsuit arising out of a fatal ATV accident which occurred in April 2018 on private property located in Tomball, Texas. Mr. Agosto and Ms. Rice represented the decedent’s widow and the couple’s two minor children in the lawsuit which was filed against the owners of the ATV and the private property where the incident occurred. At the time of the incident, the decedent was riding as a passenger in the 2014 Polaris Razor which was being driven by one of the homeowners. As the driver transitioned onto uneven terrain, he lost control of the recreational vehicle, causing it to roll over on its passenger side.

The decedent was partially ejected from the Polaris Razor and sustained significant crush injuries. He was treated on scene by local emergency medical personnel before being transported to Cypress Fairbanks Medical Center where he ultimately passed away. Investigators from the Harris County Sheriff’s Office determined that both speed and alcohol played a role in the fatal incident. During the course of their investigation, Mr. Agosto and Ms. Rice uncovered two insurance policies that provided coverage for the incident. Both insurance companies tendered policy limits to settle the lawsuit.
