Man Sues Kroger Following Injuries Caused by Dangerous Christmas Tree Display

On July 28, 2020, a Harris County resident filed a complaint in the Harris County District Court against Kroger Texas, L.P. (hereinafter “Kroger”). The man asserts allegations for negligence against Kroger as a result of an incident that caused his leg to become lacerated by a sharp tree branch protruding from a Christmas display.

On November 22, 2019, according to the lawsuit, the man was shopping at a Kroger grocery store located in Harris County, Texas. The petition describes the incident occurred when the man entered the grocery store and suffered a laceration to his leg as a result of an “errant” Christmas tree branch. The man alleges the display at the front entrance was dimly lit, was not open and obvious to him and that he had not been warned of any dangerous condition in the store entrance.

In his lawsuit, the man contends Kroger failed to warn or make safe the dangerous conditions about which it knew or could have discovered through a reasonable inspection. The man further alleges the injuries he suffered were a direct proximate result caused by Kroger’s negligence. Specifically, the man claims Kroger negligently erected the Christmas tree display, the display was dimly lit, the display was in the front entrance near a high traffic area and around places of ingress and egress, and that Kroger failed to inspect the sharp protruding branches that could have caused and ultimately did cause the man injuries.

At all times necessary, Kroger had a duty to keep and maintain the store premises-including the front entrance-in a safe condition. Due to the condition of the sharp protruding Christmas tree branch, positioned in a dimly lit display, the condition of the store premises, as the man claims, was not indeed safe for Kroger shoppers.

The man seeks monetary relief for damages resulting from, among others, past and future medical bills and expenses, physical pain and suffering, mental anguish, physical impairment and disfigurement, loss of earning capacity and lost wages, among others. The man is seeking monetary relief in an amount between $200,000.00 and $1,000,000.00.
