On July 29, 2020, a Harris County resident filed a complaint in the Harris County District Court against Wal Mart Stores Texas LLC (hereinafter “Walmart”). The woman asserts allegations for negligence against Walmart as a result of a slip and fall incident.
On May 21, 2020, according to the lawsuit, the woman was shopping at a Walmart store located at 6626 FM 1969 Atascocita, Texas. As the woman neared the area where the dairy products are displayed for shoppers, she slipped and fell in a puddle of broken eggs on the floor. The fall caused the woman to sustain serious bodily injuries including injuries to her right leg and right buttocks, among others.
In the lawsuit, the woman alleges Walmart’s negligent actions and omissions on the store premises at the time of the incident were a proximate cause of the incident including her injuries and damages resulting from the incident. Specifically, the woman claims Walmart was negligent in failing to put out a wet floor sign and/or for failing to warn invitees of the existing puddle of broken eggs on the floor.
An invitee is someone who enters a property in response to an express or implied invitation from the property owner for the benefit of both parties. A common type of invitee is a business patron, such as a shopper of a store and this characterization would apply to the woman here, as it relates to her being invited to shop in the Walmart, on the day of the incident.
At all times necessary, Walmart had a duty to keep and maintain the store premises in a safe condition. Due to the condition of the broken eggs puddle on the floor, the condition of the store premises, as the woman claims, was not safe.
The woman seeks monetary relief for damages resulting from, among others, physical pain and suffering, mental anguish, physical impairment and disfigurement, among others.
