On July 24, 2020, a Harris County woman filed a complaint in the Harris County District Court against Memorial City Mall, LP and Skechers USA, Inc. The woman brought negligence causes of action against both businesses, also alleging gross negligence and strict product liability against Skechers.
On October 1, 2018, the woman was shopping at Memorial City Mall, when she fell to the ground. She alleges the fall was a result of a dangerous condition and/or the design of her shoes. The woman sustained serious, permanent, and disabling bodily injuries as a result of this incident.
The woman alleges that Memorial City Mall failed to use reasonable care to protect her, as an invitee, from the risk accompanied by allowing a dangerous condition-here, a dangerous scooter-to exist on the premises. In particular, the woman claims that the Memorial City Mall was negligent in: maintaining the scooter in such a way that it was dangerous to use, failing to inspect the scooter to determine whether it was safe, and in failing to put the dangerous scooter out of service. In regard to Skechers, the woman alleges the Skechers shoes contributed to the incident in question, the shoes had a defective and negligent design when a safer alternative design existed, and that such shoes were defectively and negligently marketed and/or sold. Moreover, the woman claims Skechers was negligent in its design of the shoes and in failing to adequately warn customers of the dangerous condition.
The woman seeks monetary relief for damages resulting from, among others, mental and physical pain and suffering, mental anguish, physical impairment, disfigurement, lost wages, and loss of capacity to perform household services. The woman claims she has suffered past medical expenses and further claims will probably require additional medical, hospital, and drug services in the future. The woman is seeking a monetary relief in a sum over $200,000 but no more than $1,000,000.
