On June 23, 2020, a Harris County man filed a complaint in the Harris County District Court against E. Villarreal Enterprises LLC, doing business as Villarreal Drywall. The man brought negligence and gross negligence causes of action against the drywall business.
On April 8, 2020, the man was employed by Villarreal Drywall, assigned to do construction work at a new commercial building. Villarreal Drywall instructed the man to paint the ceilings. While the man was on a scaffold, he tripped and fell approximately 6 to 7 feet. The man sustained severe injuries requiring extensive medical treatment.
The man alleges his bodily injuries occurred as a result of not having the proper assistance on the scaffold. According to the man, Villarreal Drywall failed to exercise the degree of care that reasonable and prudent business entities would have. Specifically, the man alleges they failed to provide and administer an adequate safety program for employees and workers, to provide a safe working environment, to properly warn of the hazards existing in carrying out the directions of Villarreal Drywall, and to adequately instruct the man in how to carry out his duties safely. Moreover, the man alleges gross negligence as the drywall business’s conduct involved an extreme degree of risk, and it had an actual, subjective awareness of the risk involved, yet proceeded in conscious indifference to the rights, safety, or welfare of the man.
The man seeks monetary relief for damages resulting from physical pain, mental anguish, physical impairment, and disfigurement, which the man will, in reasonable probability, continue to suffer. The man is also seeking monetary relief for past and future medical treatment, as well as past loss of earnings. The man is seeking a monetary relief in a sum over $1,000,000.
