Woman Sues Kellogg’s Alleging Honey Smacks Caused Food Poisoning

On June 17, 2020, a Harris County resident filed a complaint in the Harris County District Court against the Kellogg Company. As a result, the woman brought a negligence cause of action against Kellogg’s.

On June 14, 2018, the woman purchased a 15.3 oz box of Honey Smacks cereal manufactured by Kellogg’s. After consuming the cereal, the woman suffered food poisoning, became ill, and was transported to emergency room for immediate treatment. Later the woman found out that on the day she purchased the cereal, there was a recall of that product after she purchased it.

The woman alleges that her bodily injuries occurred as a direct result of the food poisoning caused by the negligence of Kellogg’s. The woman suffered nausea and vomiting, diarrhea, and gastroenteritis or colitis. According to the woman, Kellogg’s had control over the subject cereal products it distributed at all relevant times, and therefore owed duties to the woman, which it breached. In particular, the woman alleges that Kellogg’s negligently distributed infected cereal to stores even though Kellogg’s or its agents knew or should have known both of the existence of such an issue and the likelihood of a person being injured as a result of the consumption of such cereal.

The woman seeks monetary relief damages for past and future medical care and expenses incurred by the woman for the necessary care and treatment of her injuries, past and future physical pain and suffering, and past and future mental anguish, among others. The woman is seeking monetary relief in an amount between $100,000 and $200,000, an amount within the jurisdictional limits of the Harris County District Court.
