Man Files Lawsuit Against Local Pub after Violent Beating and Stabbing Incident by the Pub's Bouncer and His Friends

On March 2, 2020, a resident of Humble filed a complaint in the Harris County District Court against Bender Square Partners, Lopez Venture Group LLC doing business as Shamrock's Pub, its bouncer Salomon Wyatt, and others. The man alleges assault and battery, negligence, and premises liability against the defendants, among other causes of action.

On September 23, 2019, the man visited Shamrock's pub, located in the retail strip center owned by Bender Square Partners. According to the man, when he began leaving the pub with his girlfriend, the pub's bouncer verbally abused and threatened him, followed by removing his shirt and punching him. The bouncer, according to the man, was a member of a biker gang and would allow his fellow gang members to gather and drink in the pub's parking lot on a regular basis, of which Bender Square Partners and Shamrock's Pub were aware of. On the day of the incident, upon seeing the altercation between the man and the bouncer, the latter's fellow gang members joined him in punching and kicking the man. Moreover, one of the gang members also stabbed the man with a knife multiple times. The man was later taken to hospital, while the bouncer and several of his friends were charged with various felony offenses.

The man is seeking recovery based on claims of premises liability, negligent hiring, training, supervision, and retention, assault and battery, vicarious liability, and gross negligence. First, the man alleges Bender Square Partners knew or should have known of the high incident of violent crime and criminal activity at Bender Square area, was obligated to take precautions to protect its invitees, yet it failed to do so, and created an unreasonable risk of harm at Bender Square. Next, the man claims that Shamrock's pub was negligent in hiring, training, supervision, and retention of its bouncer, by failing to properly supervise its security personnel and bouncers, failing to protect the man from the violent propensities of its employees, and failing to provide a safe environment for its patrons and invitees. Finally, the man brings assault and battery claims against the pub's bouncer, for threatening and beating the man, causing physical and emotional harm.

The man seeks monetary relief of more than $1,000,000, for damages resulting from past and future physical pain and suffering, past and future physical impairment, past and future mental anguish, and lost wages.
