Harris County Resident Suffers Injuries After a Slip and Fall on Katy Dealership Premises

On August 29, 2019, a Harris County resident filed a complaint against Autonation Ford Katy also known as Texan Ford Inc. in a Harris County district court, alleging injuries sustained as a result of a slip and fall incident on the dealership’s premises.

On November 1, 2017, after having delivered vehicles to the dealership at 20777 Katy Freeway, the delivery man had to unload those vehicles. To do this, he had to drive the vehicles to the back-fence line, and then walk back to the truck. A part of the area he had to walk on was unpaved, filled with pooled water and mud. While walking back to the truck after having parked one of the vehicles, the delivery man slipped in the mud, causing him to fall to the ground. As a result, he fractured his right patellar, requiring surgical repair.

The delivery man is seeking recovery alleging negligence. He claims that the acts and omissions of the dealership were a proximate cause of the slip and fall. In particular, the delivery man maintains that the dealership caused an unreasonably dangerous condition to exist on its premises, failed to place warning signs in the back-fence area to warn of the dangerous condition. The delivery man further maintains the dealership failed to adequately inspect that back-fence area and properly maintain it, further allowing the dangerous condition to remain there, and not taking any action to prevent injuries such as his own. The delivery man’s wife filed a claim against the dealership because, she maintains, the acts and omissions of the dealership caused her to suffer damages of loss of consortium with her husband and loss of household services that he has been unable to perform.

As a result of the dealership’s wrongful acts, carelessness, and omissions, as alleged, the delivery man is seeking damages and compensation for past and future medical expenses, physical impairment, physical disfigurement, loss of earnings, and loss of enjoyment of life, among others. The delivery man also seeks exemplary damages, pre-judgment, post-judgment interest, and costs of litigation. The monetary relief he seeks exceeds $1,000,000.
