Jury Awards $229M in Medical Malpractice Lawsuit

A Baltimore jury has awarded $229M in what is thought to be one of the largest jury awards for a medical malpractice lawsuit. The lawsuit was brought by a woman who alleged that her daughter suffered a brain injury at birth that now requires around the clock care.

The mother of the child was admitted at 25 weeks of gestation suffering with preeclampsia. Preeclampsia is a pregnancy complication that can cause mothers and babies to suffer from issues such as seizures and premature birth. The woman alleged that she declined a C-section (which is the safest under her conditions) because doctors wrongfully told her that the baby would die or suffer brain damage. Doctors eventually induced labor which lasted for approximately 22 hours. However, the baby's brain was deprived oxygen during labor. After delivery, the baby was diagnosed with cerebral palsy and seizures. The lawsuit alleged both conditions were caused by the doctor's erroneous information provided to the mother and decision to induce labor. The plaintiff sought monetary damages to compensate her and the baby for round the clock care.

The hospital stated it would appeal the verdict. Its spokesperson was quoted as saying the verdict was not supported by the evidence and that the hospital appropriately informed the mother multiple times of all the risks associated with her condition.
