Trucker Awarded $80M

Truck driver Lauro Lozano filed suit against JNM Express, Omega Freight Logistics, and Anca Transport and alleged that his boss made him falsify his log book to appear that he rested for the federally required 34 hours between two different routes. In reality, Mr. Lozano had finished a long route when he was asked by his boss to begin another route from Texas to Maryland.

While driving, Mr. Lozano became tired on I-59 in Alabama and fell asleep. He struck another tractor-trailer. According to his suit, Mr. Lozano suffered "severe debilitating injuries," which included a traumatic brain injury, crushed left foot, crushed pelvis, and broken ribs. The suit went on to note, "Plaintiff's extensive injuries suffered as the result of the collision caused him to incur significant medical expenses and loss of income." A jury agreed and awarded Mr. Lozano $5 million in compensatory damages and $75 million in exemplary damages. The three defendants are liable for $25 million each, although JNM Express, Omega Freight Logistics, and Anca Transport are owned by the same person.
