Patron Sues Local Bar after Large Light Fixture Falls from Ceiling

A bar patron was injured on June 22, 2018 after a large light fixture fell from the ceiling while he visited a Houston bar.

The bar patron filed a lawsuit on March 11, 2019 in Harris County against GR8 Plate Shepard LLC d/b/a Jax Grill (“Jax Grill”), the place of business where he was injured. According to the petition, the bar patron was seated at the bar area of Jax Grill. As the patron was seated at the bar, “a large fluorescent light fixture fell from the ceiling, striking him on his back, neck, and left shoulder,” causing serious injuries to the bar patron. The petition further alleges that the restaurant and bar: failed to take appropriate action to detect the presence of a defective lighting fixture hanging from the ceiling; failed to take the appropriate action to warn the bar patron of the defective lighting fixture and/or otherwise reduce or eliminate the risk posed by the dangerous condition of the lighting fixture; failed to inspect the lighting fixtures in the bar and restaurant; failed to perform standard and routine maintenance on the lighting fixture; and otherwise committed other negligent acts or omissions that all together caused the bar patron to suffer severe physical injuries.

The bar patron is seeking damages and compensation for his past and future medical expenses; past and future physical impairment; past and future pain, suffering and mental anguish; past and future physical disfigurement; and loss of enjoyment of life, among other damages. The bar patron has sued the bar and restaurant under theories of negligence and premises liability. In his petition, the bar patron alleges Jax Grill is responsible for his injuries because Jax Grill failed to correct and/or reduce and/or eliminate the unreasonable risk of harm caused by the dangerous condition and further failed to warn him about the dangerous condition.

The bar patron is seeking monetary relief in the amount of more than $200,000 but less than $1,000,000.
