“At Home” Store Sued for Injuries Caused by Chair Collapse

A customer was injured on January 19, 2019 while shopping at a local home goods store when an office chair collapsed as she seated herself to test the chair.

The “At Home” customer filed a lawsuit against At Home Stores LLC, the store where she was injured, on February 5, 2019 in Harris County. According to the petition, the shopper had been looking for office supplies and decided to test an office chair. When the shopper sat in the chair, it “immediately collapsed forward causing [her] to fall to the ground,” causing serious injuries to the shopper. The petition further alleges that an inspection by a store manager revealed several screws meant to support the base of the chair were missing.

The At Home shopper is seeking damages and compensation for her past and future medical expenses, past and future physical impairment, past and future pain, suffering and mental anguish, past and future physical disfigurement, and loss of her earning capacity, among others. The shopper has sued the At Home under theories of negligence and premises liability. In her petition, the shopper alleges At Home is responsible for her injuries because At Home created and/or failed to correct the dangerous condition and further failed to warn her about the dangerous condition.
